Dangerous/Defective Recalled Prescriptions

Over the course of a lifetime, there’s a good chance you or a loved one will be prescribed a drug(s) for any number of injuries, conditions or diseases. Although these drugs are FDA approved, it doesn’t necessarily mean the doctor or healthcare practice properly prescribed the drug or gave correct instructions.

For example, a doctor may attempt to prescribe a drug for an unintended use. This can negatively affect a patient and the doctor may be liable. Plus, an FDA-approved drug can still be at risk for being defective. Defective, dangerous or wrongly prescribed drugs can lead to unexpected side effects. These can result in illness, injury and even death.

In the state of Massachusetts, there are strict laws in place so that drug manufacturers/companies can be held responsible in instances where their drugs have caused harm, whether the drugs were used as prescribed or not.

If you or a loved one experienced unexpected side effects as a result of a prescription drug, you are not required to provide evidence that the drug manufacturer had produced a defective or dangerous drug. You’ll still be eligible to receive compensation for damages.

In other instances, sufficient proof of a drug company’s negligence will be required. If you can prove a company failed to provide a warning of a drug’s side effects, you can be compensated for the harm caused as a result of taking the medication. Damages can include any medical costs you’ve incurred as related to the drug use.

In addition, if a prescription drug’s unexpected side effects, or a drug company’s negligence, led to missed work, you’ll be eligible for compensation to cover lost wages. You also may be qualified to collect funds to cover pain and suffering. These are all things to consider when filing a claim in the event you or a loved one were negatively affected by a prescription drug.

Because some drugs have been known to have a widespread negative effect on patients, class action claims are a possibility. Otherwise, you can file an individual claim. Have you or someone you know taken one of the drugs listed below? These are some of the prescription drugs often found to have had unexpected, negative side effects.

  1. Actos (pioglitazone)
  2. Paxil (paroxetine hydrochloride)
  3. Pradaxa (dabigatran)
  4. NuvaRing (etonogestrel/ethinyl estradiol)
  5. Yaz (drospirenone/ethinyl estradiol)
  6. Lipitor (atorvastatin)
  7. Topamax (topiramate)
  8. Eliquis (apixaban)
  9. Xarelto (rivaroxaban)

We can also help you if you have been negatively affected by drugs prescribed for a meningitis outbreak, an SSRI (selective serotonin re-uptake inhibitors) case or testosterone replacement therapy (TRT).

Every year in the United States, there are potentially thousands of prescription drugs recalled by the FDA or manufacturers—there is a good chance you or a family member has been prescribed one of these. The Law Office of Frank Fernandez, personal injury lawyer in Boston, can help you understand all of the laws pertaining to dangerous or defective prescription drugs and misguided prescriptions.
